Two men were sentenced Thursday, April 20, in Fulton County Common Pleas Court:
•David P. Mann, 48, Delta; originally indicted Sept. 19, 2016, on one count each, illegal cultivation of marijuana, disorderly conduct, resisting arrest, and harassment with a bodily substance; guilty plea entered in February to one count, illegal cultivation of marijuana; on or about Aug. 19, 2016, cultivated marijuana; sentenced to two years community control, fined $500 plus court costs; ordered not to consume or possess alcohol or illegal drugs, not to enter bars or taverns, be evaluated for drug and alcohol treatment at Recovery Services of Northwest Ohio and, if recommended, be successfully discharged from the program. Mann served seven days in jail. Failure to abide by conditions could result in 11-month prison sentence.
•Ryan R. Smigelski, 27, rural Swanton; originally indicted Jan. 9, on one count each theft, forgery; entered guilty plea in February to forgery; on Dec. 20, 2016, he possessed checks of another, which he fraudulently tried to cash; placed on four years of community control; ordered to pay $500 fine, $300 restitution, stay out of bars-taverns, not to possess or consume alcohol, complete drug court program. Smigelski served 81 days in jail. Failure to comply could result in an 11-month prison sentence.
