Grand Jury Hands Down Indictments



The Fulton County Grand Jury handed down indictments against 16 persons when it met, Monday, May 21.

Scott A. Haselman, county prosecuting attorney, released the names and charges in a press release last week.

Indicted:

•Kimberly S. Baun, 45, Delta; indicted on one count, identity fraud, two counts, forgery; on or about July 25, 2011, to Aug. 5, 2012, she allegedly purposely used personal identifying information of another with the intent to hold herself out to be the other person; also allegedly forged credit card receipts.

•David A. Carner, 49, Toledo; indicted on one count, felonious assault; on or about May 13, allegedly knowingly caused or attempted to cause physical harm to another with a deadly weapon.

•Simon T. Champada, 22, Bryan; indicted on one count, having weapons while under disability; on or about May 7 to May 9, allegedly illegally possessed a firearm.

•Yvonne D. Cooker, 26, Montpelier; indicted on one count, possession of cocaine; allegedly possessed cocaine on or about April 18.

•Corbley E. Duke, 46, Toledo; indicted on one count each, breaking and entering, possessing criminal tools; on or about May 6, allegedly trespassed on the premises of a business with purpose to commit a felony crime, while allegedly having in his possession instruments intended for use in the felony crime.

•Jasmine L. Elizardo, 22, and Shawn D. O’Leary, 26, both of the same Lyons address, were each indicted on one count, possession of heroin; on or about May 3, each allegedly possessed heroin.

•William E. Kempton, 33, Wauseon; indicted on one count, aggravated possession of drugs; on or about Feb. 29, allegedly possessed bath salts (which can be used as a drug of abuse).

•Steven F. Kiefer, 23, Wauseon; indicted on three counts, aggravated trafficking in drugs, two counts, aggravated possession of drugs, one count, tampering with evidence; on or about Jan. 11 to April 26, allegedly sold bath salts, on one occasion in the vicinity of a juvenile; allegedly tampered with evidence in an investigation.

•Rollie J. Knestrick, 51, Toledo; indicted on one count each, breaking and entering, possessing criminal tools; on or about May 6, allegedly trespassed on the premises of a business with purpose to commit a felony, while allegedly having in his possession instruments intended for use in the felony crime.

•Brent B. Owczarzak, 28, Delta; indicted on one count each, tampering with evidence, forgery; on or about March 1, allegedly tampered with evidence in an investigation and forged an invoice.

•Tommy S. Partin, 45, Swanton; indicted on one count, passing bad checks; allegedly, on or about March 4, wrote a check to a person knowing it would be dishonored.

•Melvin J. Rayoum III, 19, Delta; indicted on one count, burglary; on or about April 9, allegedly trespassed in an occupied structure with purpose to commit a criminal offense.

•Eric J. Smith, 35, Lyons; indicted on one count each; sexual imposition, gross sexual imposition, unlawful sexual conduct with a minor, rape; on or about Dec. 16, 2011 to Dec. 18, 2011, Smith allegedly engaged in sexual contact and sexual conduct with a person under the age of 16 by force or threat of force.

•Joseph J. Sustaita, 34, Wauseon, indicted on two counts, trafficking in heroin; on or about Nov. 30 and Dec. 22, 2011, he allegedly sold heroin.

•Davy A. Swartz, 35, Wauseon, indicted on one count each, failure to comply with the order or signal of a police officer, felonious assault; on or about April 27, allegedly, while operating a motor vehicle, knowingly caused or attempted to cause physical harm to a peace officer.
