Five Sentenced

Scott A. Haselman, Fulton County prosecuting attorney, released sentencing information for several defendants:

•Jalen N. Brimmer, 22, Wauseon; indicted Oct. 15, 2018, on one count, tampering with evidence; entered guilty plea to charge Dec. 13, 2018; on or about Oct. 5, 2018, attempted to tamper with evidence in an official police investigation; sentenced Thursday, March 28, to three years community control; ordered to pay cost of prosecution, court-appointed attorney fees, $500 fine, complete treatment at Recovery Services of Northwest Ohio, complete court cognitive behavioral treatment program, not to consume or possess alcohol or illegal drugs in home or vehicle, not to enter bars/taverns, comply with 11 pm-6 am curfew. Failure to abide by conditions could result in 14-month prison sentence.

• Carl F. Garza, Jr., 49, Wauseon; indicted Oct. 15, 2018, on one count each, possession of criminal tools, breaking and entering, attempted safecracking, burglary; entered guilty plea Nov. 27, 2018, to one count each, trespass in a habitation when a person is present or likely to be present, breaking and entering; on or about Sept. 13, 2018, trespassed in an occupied structure when any person is present or likely to be present with purpose to commit a criminal offense; on Sept. 29, 2018, trespassed in an unoccupied business with intent to commit a theft offense; sentenced Friday, March 22, to three years community control; ordered to pay cost of prosecution, court-appointed attorney fees, $250 restitution, complete SEARCH program, aftercare, not to consume or possess alcohol or illegal drugs in home or vehicle, not to enter bars/taverns, comply with 11 pm-6 am curfew, have no contact with victim. Failure to abide by conditions could result in 28-month prison sentence.

•Justin Hahn, 32, Wauseon; indicted Sept. 17, 2018, on one count, domestic violence, a third-degree felony; entered guilty plea Dec. 12, 2018, to one count, domestic violence, a second-degree misdemeanor; on Aug. 26, 2018, by threat of force caused a family or household member to believe that he would cause imminent physical harm to them; sentenced Thursday, March 28, to 30 days at the Corrections Center of Northwest Ohio with work release, ordered to pay cost of prosecution.

•Thomas Partin, 52, rural Swanton; indicted Aug. 20, 2018, on one count, possession of cocaine; entered guilty plea Nov. 6, 2018; possessed cocaine Nov. 11, 2017; sentenced Friday, March 22, to 60 days at CCNO with credit for days served; placed on two years community control; ordered to pay cost of prosecution, not to consume or possess alcohol, stay out of bars/taverns; be assessed for dual-diagnosis at A Renewed Mind, complete treatment. Failure to abide by conditions could result in 11- month prison sentence.

•Benjamin Wagner, 44, Delta; indicted Oct. 15, 2018, on two counts, operating a motor vehicle while intoxicated; entered guilty plea Dec. 18, 2018, to charge; on Sept. 29, 2018, operated a motor vehicle while under the influence of alcohol; sentenced Thursday, March 28, to 90 days at CCNO, to be on transdermal alcohol detector monitoring for 180 days after completion of jail sentence; placed on two years community control; driver license suspended for five years; ordered to complete treatment at A Renewed Mind, stay out of bars/ taverns, not to consume or possess alcohol, forfeit vehicle to state of Ohio. Failure to abide by conditions could result in 12-month prison sentence.
