Archbold Man Found Guilty In Jury Trial




Johnathon Gaines, 29, Archbold, was found guilty of receiving stolen property by a jury in Fulton County Common Pleas Court, Wednesday, April 10.

Scott A. Haselman, Fulton County prosecuting attorney, said in a press release the jury deliberated about 30 minutes before returning the guilty verdict.

Paul H. Kennedy, assistant prosecuting attorney, presented the state’s case, which lasted two days.

Archbold police investigated the case, which had its origins in a Sept. 18, 2012, incident.

Police were called to the East Gardens apartment complex about 1:54 am that day on a report of a fight in a hallway at the 700 building.

No one around when officers arrived, but they received word one of the participants was planning to leave on a motorcycle.

Officers went to the lot, where they found a motorcycle. Its identification number indicated it was stolen in Toledo.

Police had it picked up and secured.

Gaines is currently free on his own recognizance. A pre-sentence investigation report has been ordered, and his own recognizance bond was continued.

Three other persons were recently sentenced:

•Ryan Smigelski, 23, rural Swanton; previously pled guilty to safecracking and burglary; on Oct. 6, 2012, stole cash from a safe; between Nov. 5-8, 2012, broke into a Swanton home and stole jewelry and coins; sentenced to 24 months in prison, ordered to make $17,033 in restitution.

•Richard Vogelsong, 32, Wauseon, previously pled guilty to theft; between April 1-May 12, 2012, stole personal property, including all-terrain vehicle parts, a playground set, two tool boxes, and two patio lounge recliners from a neighbor; sentenced to 10 days at the Corrections Center of Northwest Ohio; placed on two years community control; ordered to pay prosecution costs, attorney fees, $250 cash fine, obtain general education diploma (GED), maintain employment, stay out of bars/taverns, abide by an 11 pm to 6 am curfew; failure to comply could result in 11- month prison sentence.

•Brent Hardy, 30, rural Wauseon; convicted of vehicular assault; on June 23, 2012, as the result of being intoxicated, caused an accident on US20 near Co. Rd. 14, resulting in serious injury to a Montpelier man; sentenced to nine months in prison, to be served consecutively with six-month sentence from an unrelated case; driver license suspended for two years, six points assessed against license.
